Motorbike riders are particularly vulnerable if involved in a road traffic accident. Tragically, many accidents are fatal or result in very serious injury. The majority of accidents involve collisions with other motor vehicles, with approximately 20% being single vehicle accidents. Statistics reveal that typically motorbike collisions are ‘right of way’ accidents caused by driver or rider error with speed being a significant contributing factor. Loss of control at bends or changes in road conditions, overtaking or filtering through built up traffic are common situations which give rise to accidents.

Liability

The nature and circumstances of motorbike accidents often result in liability being in dispute, particularly where speed is a factor. The cause of the accident may not always be obvious and the offending driver may not be willing to accept liability. Often, an allegation is made that the motorbike rider created a danger and was negligent contributing to his own injuries. A finding of contributory negligence against the plaintiff may defeat the claim entirely or reduce the level of compensation awarded.  Apportionment of liability is often a tricky issue in motorbike cases and expert legal advice should always be sought if you have been involved in a motorbike accident.
